Consumer Commission Fines Firm for False Weight-Loss Claims: A Wake-Up Call for Misleading Advertisements

Consumer Commission Fines Firm for False Weight-Loss Claims: A Wake-Up Call for Misleading Advertisements

The Ghaziabad District Consumer Disputes Redressal Commission (DCDRC) has once again reminded us that consumers cannot be misled by tall claims and glossy advertisements.

Case Snapshot

  • Case: Vikas Tyagi v. Vedas Cure Private Limited

  • Forum: District Consumer Disputes Redressal Commission, Ghaziabad

  • Date of Complaint: September 2022

  • Decision: September 2025

  • Order: Refund of ₹2,400 (purchase price), plus ₹10,000 as fine/compensation, payable within 45 days, failing which 6% annual interest will apply.

What Happened

The complainant purchased an “Ayurvedic” weight-loss formula from Vedas Cure Pvt Ltd, Noida, which claimed:

  • Guaranteed weight loss of 4–5 kg per month

  • Absolutely no side effects

However, reality told a different story. The customer’s wife, who consumed the product, not only failed to lose weight but also suffered from headaches and raised blood pressure. To make matters worse, the medicine arrived unsealed, with no transparent details of its ingredients.

The consumer approached the forum, alleging misleading claims and deficiency in service.

Commission’s Findings

The DCDRC held that:

  • The company engaged in unfair trade practice by making false health claims.

  • Absence of sealed packaging and proper labeling violated consumer rights.

  • The product caused adverse effects contrary to its claims of “no side effects.”

Accordingly, the forum directed the firm to refund the product cost and imposed a fine for causing harassment and loss to the consumer.

Why This Matters

This case underlines a critical point: Health-related products must be backed by evidence, not hype. Misleading advertisements can:

  • Cause direct health risks

  • Cheat consumers financially

  • Erode trust in traditional systems like Ayurveda

It also showcases the power of the Consumer Protection Act, 2019, which recognizes misleading advertisements as a specific form of unfair trade practice.

Lessons for Consumers

  1. Don’t trust tall claims blindly—always verify.

  2. Preserve bills, receipts, and packaging—they become vital evidence.

  3. Seek redressal—consumer forums are accessible, affordable, and effective, even if the process takes time.
